1. Acceptance of these terms
By accessing fikrahdigital.com or engaging Fikrah Digital ("Fikrah", "we", "us") for services, you agree to these Terms. If you do not agree, please do not use the website or our services.
2. About Fikrah Digital
Fikrah Digital is a Dubai-based marketing agency providing services across paid media, performance marketing, creative and content production, SEO, marketing automation, CRM, and growth strategy.
3. Services and engagements
These Terms govern your use of our website. The specific scope, deliverables, fees, and timelines of any paid engagement are set out in a separate written proposal or agreement (the "Agreement"), which prevails over these Terms in case of any conflict regarding that engagement.
4. Acceptable use of the website
You agree not to misuse the website, attempt unauthorised access, disrupt its operation, or use it for any unlawful purpose.
5. Fees and payment
Service fees are agreed in the Agreement before work begins. Unless stated otherwise, invoices are payable in advance or per the agreed schedule. Advertising media budgets are separate from our fees and are paid directly to the relevant platforms.
6. Client responsibilities
You are responsible for providing accurate information, timely approvals, and the necessary access to accounts and assets. Advertising and analytics accounts remain your property. You confirm that you hold the rights to any materials you provide to us.
7. Intellectual property
Final deliverables created specifically for you (such as ad creative, copy, and designs) become your property upon full payment. Fikrah retains ownership of its pre-existing tools, methods, templates, and know-how. All content on fikrahdigital.com is owned by Fikrah.
8. Third-party platforms
Our services rely on platforms such as Google, Meta, TikTok, and Snapchat, which are governed by their own terms and policies. We are not responsible for platform decisions, outages, policy changes, account suspensions, or pricing changes outside our control.
9. No guarantee of results
Marketing performance depends on many factors beyond our control, including market conditions, competition, budgets, and platform behaviour. We commit to professional effort and sound methodology, but we do not guarantee specific results unless expressly stated in the Agreement.
10. Limitation of liability
To the maximum extent permitted by law, Fikrah’s total liability arising from any engagement is limited to the fees you paid for that engagement in the three months preceding the claim. We are not liable for indirect or consequential losses.
11. Confidentiality
Each party will keep the other’s non-public information confidential and use it only for the purpose of the engagement.
12. Term and termination
Either party may terminate an ongoing engagement with 30 days’ written notice, unless the Agreement states otherwise. Fees for work performed up to the termination date remain payable.
13. Governing law
These Terms are governed by the laws of the United Arab Emirates, and the courts of Dubai have jurisdiction over any dispute arising from them, without prejudice to any mandatory consumer rights.
14. Changes to these terms
We may update these Terms from time to time. The current version is always posted on this page with its effective date.
